Terms & Conditions

These Terms & Conditions govern all orders placed with Deviously Delicious Cakes. By placing an order, you agree to the following terms.

 

​1. Orders & Availability​

​

  • All products are made-to-order from our home bakery.

  • Orders are accepted on a first-come, first-served basis, and availability may be limited based on our schedule.

  • We reserve the right to decline or cancel an order at our discretion (in which case any payments made will be refunded).

 

2. Deposits & Payments​

​

  • A 50% non-refundable deposit is required to confirm all advance orders.

  • Full payment is due at least 7 days before pickup or delivery.

  • Orders placed within 7 days of the event must be paid in full at the time of booking.

  • Payment confirms your agreement to these Terms & Conditions.

 

3. Cancellations & Refunds​

​

  • All cancellations and refunds are subject to our Refund & Cancellation Policy, which is incorporated by reference into these Terms.

  • Please review that policy for details regarding deposits, quality concerns, and store credits.

4. Delivery & Pickup​

​

  • Delivery is available for an additional fee, which will be quoted at the time of order.

  • Customers are responsible for providing accurate delivery information.

  • Once an order leaves our possession, Deviously Delicious Cakes is not responsible for damage due to handling, transportation, or storage by the customer.

 

5. Allergies & Dietary Restrictions

  • Our products are prepared in a home kitchen that may process common allergens including, but not limited to: wheat, dairy, eggs, soy, peanuts, and tree nuts.

  • While we take care in preparation, we cannot guarantee that products are free from cross-contamination.

  • It is the customer’s responsibility to inform guests of potential allergens.

 

6. Design & Decorations

​

  • Custom cakes and treats are handcrafted and may vary slightly from inspiration photos due to artistic interpretation, available materials, and environmental conditions.

  • Colors, textures, and decorations may differ from images provided by the customer or samples viewed online.

7. Liability

​

  • Deviously Delicious Cakes is not liable for:

    • Damage to products once picked up or delivered.

    • Issues caused by customer-provided storage, handling, or display conditions.

    • Events outside of our control, such as weather, traffic delays, or third-party service disruptions.

8. Governing Law

​

  • These Terms & Conditions are governed by the laws of the State of Texas.

  • Any disputes will be handled in accordance with Texas state law.
